SCOPE
These General Terms and Conditions apply to all services offered by ARKANA Forum GmbH. Deviating conflicting or supplementary general terms and conditions referred to by you do not become part of the contract, even if they are known, unless ARKANA Forum GmbH has expressly agreed to their validity in writing.
REGISTRATION
Only the online registration constitutes a binding offer to conclude a service contract with ARKANA Forum GmbH. By clicking on the "Book for a fee" button, you bindingly declare that you want to book the selected event. In the case of bookings made electronically, ARKANA Forum GmbH will immediately confirm receipt of the booking request. The automatic confirmation of receipt does not yet constitute binding acceptance of the booking. The service contract is only concluded upon receipt of the written confirmation or upon receipt of the invoice as acceptance of the offer to conclude a service contract. All registrations will be booked in the order in which they are received.
PAYMENT TERMS
The participation fee including VAT agreed upon during the registration process and shown in the invoice is per person. It must be paid in advance. Approximately 4 weeks before the event you will receive an invoice. The participation fee is due 14 days after the invoice date and must be received by ARKANA Forum GmbH no later than 3 days before the start of the event. In the event of non-payment, they shall be in default upon the occurrence of the due date without a reminder. If the payment of the participation fee has not been received by ARKANA Forum GmbH at the beginning of the event, ARKANA Forum GmbH is entitled to prohibit you from participating in the event.
SET-OFF / RETENTION
Offsetting against counterclaims on your part is only permissible if and to the extent that these claims have been recognized by ARKANA Forum GmbH as existing and due or their justification has been legally established.
You are only entitled to exercise a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.
CANCELLATION / NO-SHOW
Bookings can be cancelled at any time. However, this is only possible in writing.
The following cancellation fees will apply (depending on the date of receipt of the mail).
In each case, they are permitted to prove that in the specific case no damage has occurred or is significantly lower than the specified cancellation fee.
If the registered person does not show up without cancellation, 100% of the participation fee plus VAT must be paid.
CANCELLATION / CANCELLATION OF SEMINARS
ARKANA Forum GmbH reserves the right to cancel the event due to insufficient demand or if other conditions essential for the implementation of the seminar change without ARKANA Forum GmbH being responsible for this and the implementation of the event becomes unreasonable for ARRKANA Forum GmbH at the latest 14 days before the planned date of the event. Participation fees already paid will of course be refunded. Further liability and damage claims that do not concern injury to life, limb or health are excluded, unless there is intent or gross negligence on the part of ARKANA Forum GmbH. This also applies to damage caused by hotel rooms that you have already booked as well as flight and train tickets.
SUBJECT TO CHANGE
ARKANA Forum GmbH is entitled to make necessary changes or deviations in terms of content, methodology and organisation (e.g. due to changes in the law) before or during the event, provided that these do not significantly change the benefit of the announced event for the participants. ARKANA Forum GmbH is entitled to replace the designated speakers in case of necessity (e.g. illness, accident) with other persons equally qualified with regard to the announced topic. The documents provided as part of the training are prepared to the best of our knowledge and knowledge. Liability and guarantee for the correctness, topicality, completeness and quality of the content by ARKANA Forum GmbH are excluded.
TECHNICAL REQUIREMENTS FOR PARTICIPATING IN WEBINARS
When participating in a webinar, each participant is obliged to meet the minimum requirements (internet connection, current browser version, downloading a program from the webinar platform if applicable, loudspeaker or headset) and to test it before the webinar begins.
The failure of the technical requirements for which the participant is responsible does not release the participant from the contractual obligation to pay. If a participant does not report any technical problems during a webinar and the recording does not reveal such messages, participation is deemed to have been properly performed and the service of ARKANA Forum GmbH is deemed to have been properly performed.
If webinars are offered afterwards as a recording and/or video course, failures may occur due to maintenance work or force majeure. In these cases, ARKANA Forum GmbH does not owe any availability of the recordings at all times.
RULES OF PARTICIPATION
In the interest of all participants, every single participant in an event is obliged to behave considerately and to observe the rules customary for such events. In the event of gross violations, the course management and the lecturer are entitled to temporarily or permanently exclude the participant in question from the further course after prior admonition and threat of exclusion. The participant's obligation to pay the participation fee remains unaffected by this exclusion.
LIABILITY FOR TRAINING CONTENT AND TRAINING DOCUMENTS
Despite the greatest possible care in the selection of training personnel, ARKANA Forum GmbH cannot assume any liability for event content or training materials.
The documents provided as part of the training are prepared to the best of our knowledge and knowledge. Liability and guarantee for the correctness, topicality, completeness and quality of the content by ARKANA Forum GmbH are excluded.
LIMITATION OF LIABILITY AND DISCLAIMER OF LIABILITY
COPYRIGHT
The content of all events as well as all materials (seminar documents, webinar content, webinar documents, recordings provided, etc.) are the intellectual property of ARKANA Forum GmbH or the respective speakers and are protected by copyright. They may only be used by the registered participant to whom they have been made available. In particular, even partial publication, duplication, distribution and editing as well as the recording of an event in audio or video or by means of screenshots are not permitted. Any misuse can be prosecuted.
Each participant is obliged to protect the copyrights and, in particular, to use the webinars for their own individual use only within the framework of the contractual agreement.
If, in exceptional cases, further use is to take place, this requires the prior written consent of ARKANA Forum GmbH. In this case, too, any consent given is only valid for the participant's own training purposes, but not for any kind of disclosure to or use by third parties.
PHOTO AND FILM RECORDINGS
Photography and filming are generally prohibited and only permitted after consultation and approval by the course instructor and with the consent of the persons depicted.
WRITTEN FORM
Ancillary agreements and amendments to a contract must be made in writing in order to be effective. This requirement can only be waived in writing.
PLACE OF PERFORMANCE / PLACE OF JURISDICTION
The place of performance for all mutual obligations is Freiburg.
The exclusive place of jurisdiction for all disputes is Freiburg, Germany. However, ARKANA Forum GmbH is entitled to sue the contractual partner at its statutory place of jurisdiction.
APPLICABLE LAW / SEVERABILITY CLAUSE
German law applies exclusively, with the exception of the provisions of private international law.
Should one or more provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision is to be replaced by a provision whose economic success comes as close as possible to that of the invalid provision. The same applies in the event of the occurrence of regulatory gaps.
EXCERPT DATA PROTECTION
The protection of your data is very important to us. The data provided with your registration is used exclusively for the organization of this event, so that we can inform you and keep you informed about other events. Your data will not be passed on to third parties outside the inomed Group. If you do not wish to receive any further information about the event, please let us know. For further details, please refer to our privacy policy.

CANCELLATION POLICY
RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day of conclusion of the contract.
In order to exercise your right of withdrawal, you must inform us (ARKANA Forum GmbH, Im Hausgrün 29, 79312 Emmendingen, Phone: 0049 7641/962 232-0, Email address: ) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the attached sample withdrawal form for this, but this is not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
CONSEQUENCES OF REVOCATION
If you withdraw from this contract, we shall reimburse you all payments we have received from you, including delivery costs (except for the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; in no case will you be charged any fees for this repayment.
If you have requested that the service or delivery should commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
